This Agreement shall be binding upon the heirs, executors, administrators, personal representatives, successors and assigns of User.
Ecofinal's failure to either enforce at any time any provision contained in this Agreement or to exercise any right, privilege, or legal remedy, shall not be deemed a waiver of such provisions or right, remedy, or privilege
